Obtained favorable USPTO decision against Apple, Inc., opposing registration of the marks REALITY CONVERTER and REALITY COMPOSER based on descriptiveness. Apple filed and succeeded using a second bite with a rarely used federal district appeal de novo, this time hiring 3 experts opining inherent distinctiveness based language uses, consumer recognition, and acquired distinctiveness, the expert reports comprising thousands of pages. Lesson learned, don't fight Goliath two times without at least 3 slingshots.
